“Ngeh Koo Ham [https://www.malaysiakini.com/news/547275] has hit the nail on the head when he said that the Federal Constitution should not be subservient to the Standing Orders of the House.  The latter are not even considered laws but rules to regulate meetings of the House.

If it is otherwise as asserted by Speaker Azhar, then we would have the absurd situation of a PM insulating himself from motion of no confidence in the House perpetually, thus rendering Article 43 (4) of the Federal Constitution meaningless (This article dictates that the PM must either resign or request to the Agong for dissolution of parliament when he loses the support of the majority of MPs).

Common sense also dictates that such a motion of no confidence must be placed at the top of the agenda (and not the last), otherwise the House would be wasting its time discussing other items of the agenda when the government may fall imminently.”
